First Post! Update to Homeowners

The purpose of this blog entry is to provide homeowners with an update on the condition of the Homeowner’s Association (HOA) as of July 2011 and the steps that have been taken since then to correct some significant problems.  There was a significant changeover in the Board this past July (3 departures and 2 additions) and unfortunately several serious issues were discovered regarding the state of the HOA that required immediate attention.  The best way to explain and understand the state of affairs is to review the Board minutes from the recent July and August board meetings.

We decided to take down the previous HOA website and work on a new design because we received so much negative feedback and frankly there were very few visitors.  There were numerous corrupted files and dead links.

On a positive note, the Board is pleased to report that on August 26th, albeit after significant time and expense, we were able to retroactively reinstate the non-profit incorporation of the Nisqually Estates HOA with the WA Secretary of State after it had been administratively dissolved in 2008.  This was not a simple or inexpensive task as so much time had passed that the Secretary of State would not allow just a simple payment of past due fees.  The HOA risked losing our UBI number, Corporate Name and would have had to completely re-incorporate with new By-laws and Articles of Incorporation.  We had to hire competent legal counsel, submit a formal written appeal, file a sworn affidavit and hope the Secretary of State would rule in our favor.

We were also able to properly file our past years tax documents with the IRS for tax years 2009 and 2010 after consulting with a professional accounting firm.  Furthermore, we instituted a periodic ACC observation method with a graduated notification system for notifying homeowners and renters of CC&R violations.  We have also filed liens on homes that have not paid dues for 2011…something that should have been done when those homeowners were just 30 days past due.  Most significantly, we were able to provide organization to the HOA records compared to what was handed to us in disarray.

Finally, there is still much work ahead to bring the HOA back to an operating efficiency commensurate with a first class neighborhood.  We ask for your patience and understanding as we begin to get things back on track.  If you would like to help the neighborhood improve, we encourage you to volunteer for the Architectural Control Committee (ACC), help out with Neighborhood Watch or just simply attend the next Annual meeting on October 15th, 2011 at the Rosemont Retirement Center at 9:30 am in Yelm.  We will start signing in homeowners and counting proxies at 9:30 am.  The meeting will begin once a quorum is achieved.  Please show up a little early to sign in.
